The lawful grounds on which we collect and process your personal data

We only process your personal information when we believe it is necessary and we have a valid lawful ground to do so. We may process your personal data relying on one or more of the following legal grounds:

  • Consent. We may process your personal data where you have given us your permission (i.e. consent) for example to send you updates about Celebration Day or where you agree to the use of non-essential cookies. You may withdraw your consent at any time by contacting us, following the unsubscribe instructions in our emails, or updating your cookie preferences.
  • Performance of a Contract. We may process your personal data to fulfil our contractual obligations to you, or where you ask us to take steps before we enter into a contract with you.
  • Legitimate Interests. We may process your personal data where it is necessary for our legitimate interests in operating, maintaining and promoting the Website and the Celebration Day campaign, and where those interests do not override your interests and fundamental rights.
  • Legal Obligations. We may process your personal data to comply with legal or regulatory obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.

Disclosures of your personal data

We may share your personal data with third parties in accordance with the purposes set out in 'How we use your personal data'. In particular, we may share your personal data with the following third parties:

  • Our charity partners, media agencies or news organisations, or other third parties necessary to enable us to carry out Celebration Day activities or promotional work.
  • Third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work.
  • Where disclosure is necessary to enable us to enforce our legal rights, or to protect the rights, property or safety of our employees or where such disclosure may be required by law (including without limitation to any legal adviser, court, charity regulator or other relevant authority).
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. We may need to share your personal data in the event of a business or asset sale or transfer, or if we merge or amalgamate our business. We process your personal information for this purpose because we have a legitimate interest in ensuring our business can be continued by the future owner. If you object to our use of your personal information in this way, the owner of our business may not be able to provide services to you. If such a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

Where we engage third-party organisations (other than in compliance with legal obligations and the authorities) to process personal data on our behalf, we will make sure they act only in accordance with our instructions and that adequate safeguards including contracts are in place to protect your personal data.

This means that these third parties cannot do anything with your personal information unless we have instructed them to, and that they must not share your personal data with any other third parties who are also providing services to us.

Third party links and sites

Our Website may, from time to time, contain links to and from the websites of third parties, or embedded content from third-party platforms. We are not responsible for the safety of any data that you share with third parties that we may link to, or that may be displayed on our Website, but are not affiliated with us. The inclusion of a link to a third-party website, service, or application does not imply a paid partnership or endorsement by us.

Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by such third parties. Any data collected by third parties is not covered by this privacy notice and may be subject to their own privacy policies. You should review the policies of these third parties before you submit any personal data to these websites or use their services and contact them directly if you have any concerns.

International transfers

Where your personal data is shared with third parties performing services for us or on our behalf, this may involve transferring personal data outside the UK to countries which have laws that do not provide the same level of data protection as in the UK.

Whenever we transfer your personal data out of the UK to service providers (or service providers transfer data to their service providers outside the UK), we ensure a similar degree of protection is afforded to it by ensuring that certain safeguards are in place as required by applicable data protection law. For instance:

  • We (or the service provider) may transfer your personal data to countries that have been deemed by the UK to provide an adequate level of protection for personal data.
  • We (or the service provider) may use specific standard contractual terms approved for use in the UK which give the transferred personal data the same protection as it has in the UK.

How long we keep your personal data

We only keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law. Where we no longer have a lawful ground for continuing to process your personal data, we will either delete it or anonymise it, or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store your personal data and isolate it from any further processing until it can be deleted. We may use anonymised data indefinitely without notifying you. We use this anonymised information to improve the way we work and our Website.

Data security

Personal data you provide to us is stored on secure servers operated by our service providers. We implement technical and organisational security measures to protect the personal data we process. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Automated processing

We do not make decisions based solely on automated processing or profiling that produce legal effects concerning you (or have similarly significant effects).

Your legal rights

Under applicable data protection laws, you have some or all of the following rights in certain circumstances:

  • Access. Request access to and/or a copy of the personal data we process about you (commonly known as a data subject access request). This enables you to check that we are lawfully processing it.
  • Correction. Request correction of any incomplete or inaccurate data we hold about you. (We may need to verify the accuracy of the new data you provide to us.)
  • Restriction. Request that we restrict or suspend our processing of your personal data.
  • Deletion. Request that we delete or remove personal data where there is no good reason for us continuing to process it.
  • Objection. Object to us processing your personal data where we are relying on legitimate interests as the lawful basis and you feel the processing impacts on your fundamental rights and freedoms, or the processing is for direct marketing purposes.
  • Data portability. Request transfer of your personal data to you or your chosen third party in a structured, commonly used, machine-readable format.
  • Withdraw consent. Withdraw your consent at any time where we are relying on consent to process your personal data. You can withdraw your consent at any time by contacting us or by following the instructions in our emails. Please note that after you withdraw your consent, we may not be able to provide certain information to you. We will advise you if this is the case at the time you withdraw your consent.

You can exercise these rights by contacting us via the contact details provided in this privacy notice. You will not usually have to pay a fee to exercise your rights. However, we may charge a reasonable fee or refuse if your request for access is clearly unfounded or excessive.

Changes to this privacy notice and your duty to inform us of changes

We may update this privacy notice from time to time in order to remain compliant with relevant laws, or for other reasons. The updated version will be indicated by an updated 'Last updated' date in this privacy notice. We will notify you of the changes where required by law to do so.

It is important that the personal data we hold about you is accurate and current. All personal data that you provide to us must be true, complete, and accurate, and you must notify us of any changes to your personal information.

We use the following cookies:

  • Strictly necessary cookies. These are cookies that are required for the operation of our Website. These essential cookies are always enabled because our Website won’t work properly without them. • Analytical or performance cookies. These allow us to recognise and count the number of visitors and to see how visitors move around our Website when they are using it. This helps us to improve the way our Website works.
  • Functionality cookies. These are used to recognise you when you return to our Website.
  • Targeting cookies. These cookies may record your visit to our Website, the pages you have visited and the links you have followed. They may be used to measure the effectiveness of communications or promotional activities, where applicable.

You can find more information about the individual cookies we use and the purposes for which we use them by clicking on the cog icon at the bottom right of this page, selecting “Change your consent”, and then navigating to the “Details” tab. In addition to the controls provided on our Website, most browsers will allow you to turn off cookies, although please note that turning off cookies may restrict your use of the Website.

You can also visit the About Cookies website for more information about cookies and how to manage them.

Third party cookies

Please note that third parties may also use cookies, over which we have no control. These third parties may include, for example, advertising networks and providers of external services like web traffic analysis services.
